Scope of Duties
The Consultant will serve as a freelance contributor for the International Journalists’ Network (IJNet). The Consultant will be responsible for writing originally reported articles to be published on IJNet for a maximum of 24 articles per year. Each article’s topic and direction must be discussed, and mutually agreed upon, by the Consultant and the relevant IJNet Director or IJNet Managing Editor. For articles written in IJNet’s non-English languages, the topic and direction must be discussed, and mutually agreed upon, by the Consultant and the designated IJNet language editor.
The work and services herein provided for shall be furnished from time to time, on a project by project basis upon the written request by Company.
The Consultant reports directly to the International Center for Journalists.
Consultant Status
In the performance of the work and services hereunder, Consultant shall act solely as an independent consultant and contractor, and nothing herein contained or implied shall at any time be so construed as to create the relationship of employer and employee, partnership, principal and agent, or joint adventurer as between Company and Consultant.
Rate of Compensation. Compensation for Consultants for rendering the services described above at a maximum fee of $200 per published article. The fee will be paid upon timely receipt of an invoice. ICFJ will not pay for recipient’s bank fees on wire payments.
Payment of Expenses. There will be no additional expenses for this work.
Travel Insurance. There will be no travel for this work.
Indemnification. The Consultant warrants that their duties performed is original and does not infringe on the copyright of another. The Consultant agrees to release, discharge and hold harmless the Company, its employees and agents, all persons acting under its authority, and those for whom it is acting, from all claims, causes of action, and liability of any kind, in law or equity, based upon or arising out of this Agreement including, without limitation, claims of libel, slander, invasion of privacy, right of publicity, defamation, trademark infringement and copyright infringement.
Ownership. Consultants will acknowledge that content produced for IJNet is the property of the International Center for Journalists, and cannot be republished or otherwise sold to another outlet without permission from ICFJ.
Provision Against Support of Terrorism
It is also understood and agreed that under ICFJ’s agreement with the U.S. Department of State, ICFJ must comply with U.S. Executive Order 13224 and U.S. laws prohibiting transactions with, and the provision of resources and support to, individuals and organizations associated with terrorism. It is ICFJ’s responsibility to ensure that its subcontractors including trainers, consultants and part-time office assistant are aware that ICFJ must comply with the Executive Order and laws.
PROVISION 23 – EXECUTIVE ORDER 13224, BLOCKING PROPERTY AND PROHIBITING TRANSACTIONS WITH PERSONS WHO COMMIT, THREATEN TO COMMIT, OR SUPPORT TERRORISM
Executive Order 13224 designated 27 individuals and entities that commit or prose a significant risk of committing terrorist acts and authorized the Secretary of State to designate additional individuals and entities. The Order also authorized the Secretary of Treasury to designate additional individuals and entities that provide support or services to, are owned or controlled by, act for or on behalf of, or are “otherwise associated with,” an individual or entity who has been designated in or under the Order. All property and interests in property of the individual or entity in the United States or in the possession or control of U.S. persons are blocked. The Order prohibits all transactions and dealings in blocked property or interests in the U.S. or by U.S. persons, and also prohibits transactions with, and provision of support for, individuals or entities listed in or subject to the Order. As of November 22, 2002, the number of designated individuals and entities was in excess of 250.
The Consultant should be aware of Executive Order 13224 and the names of individuals and entities designated there under. A list of these names can be found at the Web site of the Excluded Parties List System (EPLS). The Web site is http://www.epls.gov.
The Consultant is reminded that U.S. Executive Order and U.S. law prohibits transactions with, and the provision of resources and support to, individuals and organizations associated with terrorism. It is the legal responsibility of the recipient/contractor to ensure compliance with these Executive Orders and laws.
While ICFJ does not put any restrictions on personal time, the Center cautions the Consultant to refrain from activities that could be seen as conflicts of interest, or might jeopardize ICFJ's ability to successfully complete this or any future projects.
